1. Scope of Services
These Terms and Conditions ("Agreement") govern the provision of consultation services by GoPath Germany ("The Consultant," "We," "Our") to the client ("The Client," "You") regarding study, Master's, and vocational training (Ausbildung) pathways in Germany.
1.1. Consultation Only: GoPath Germany provides advisory, document review, and application management services. We do not provide legal immigration advice (unless explicitly stated by a certified legal partner) and are not a representative of the German government or any embassy.
1.2. Exclusion of Guarantees: We do not, and cannot, guarantee visa issuance, university admission, or securing an Ausbildung contract. The final decision rests solely with the German authorities or the hiring company. Our guarantee is only on the accuracy and completeness of the documentation we prepare.
2. Client Responsibilities
The Client agrees to
2.1. Provide Accurate Information: Furnish all requested documents and information truthfully, accurately, and on time. Any false or misleading information provided by the Client will immediately terminate this Agreement, and fees paid will be forfeited.
2.2. Pay Fees: Pay all agreed-upon consultation fees according to the payment schedule outlined in the separate Service Contract.
2.3. Language Proficiency: Acknowledge and agree that achieving the required German language proficiency (usually B1/B2) or English proficiency is the Client’s responsibility and is necessary for visa approval.
3. Fees and Payment
3.1. Non-Refundable Deposit: A non-refundable initial payment or consultation fee is required to commence services. This amount covers administrative costs and initial file assessment.
3.2. Fee Structure: Service fees are determined by the specific pathway chosen (Academic, Ausbildung, Visa Support) and are outlined in the separate signed Service Contract.
3.3. Government/Third-Party Fees: All government fees (visa application, blocked account, translation, notarization, etc.) are the sole responsibility of the Client and are not included in GoPath Germany’s consultation fees.
4. Refund and Cancellation Policy
4.1. Cancellation by Client: If the Client cancels the service after the initial assessment has been completed, all fees paid up to that point are non-refundable, as the work (file analysis, strategy development) has already been performed.
4.2. Visa Rejection: In the event of a visa rejection, GoPath Germany is not obligated to refund any consultation fees, as our service was limited to the preparation and review of the documents, which was completed. We will, however, offer a subsidized service to assist with the appeal process.
4.3. Refund Exception: Refunds will only be considered if GoPath Germany is unable to provide the service explicitly outlined in the Service Contract due to internal reasons.
5. Data Protection and Confidentiality
5.1. Data Usage: We commit to protecting your personal and academic data. Information provided will only be used for the purpose of application, visa management, and communication.
5.2. Disclosure: By accepting these T&Cs, you authorize GoPath Germany to share your necessary personal data with third-party institutions (universities, language schools, potential employers in Germany) required for the successful processing of your file.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Insert Your Operating Country's Law, e.g., Germany or Egypt]. Any disputes arising from this Agreement will be subject to the jurisdiction of the courts of [Insert City/Region of Operation].
